Порядок перехода полномочий и обязанностей президента страны в случае его смерти, импичмента или отставки определен разделом 1 статьи II [Article II, Section 1] Конституции США [Constitution of the United States]. Полномочия и обязанности переходят в следующем порядке: к вице-президенту США [Vice-President, U.S.], далее к спикеру Палаты представителей [Speaker of the House], исполняющему обязанности председателя Сената США [president pro tempore], государственному секретарю [Secretary of State], министру финансов [Secretary of the Treasury], министру обороны [Secretary of Defense], министру юстиции [Attorney General of the United States] и т.д. в порядке исторической хронологии образования соответствующих министерств. Министры могут лишь временно замещать президента, до того момента, когда эти обязанности можно будет возложить на спикера Палаты представителей или исполняющего обязанности председателя Сената США. Действующий порядок преемственности основывается на положениях Закона 1947 о преемственности президентского поста [Presidential Succession Act of 1947] и положениях Двадцать пятой поправки [Twenty-fifth Amendment] к Конституции США, ратифицированной в феврале 1967.
